Terms of Service

1. Acceptance of Terms
By accessing or using Spectre AI Pro (the “Service”), you agree to be bound by these Terms of Service (the “Terms”). If you do not agree to these Terms, you must not access or use the Service. These Terms constitute a binding agreement between you and Spectre AI Pro (the “Company”, “we”, “us”).
2. Eligibility
You must be at least 16 years of age to use the Service. If you are between 16 and 18 years old, you confirm that you have the legal capacity to enter into these Terms, including any consent required under Article 8 GDPR. If you are using the Service on behalf of an organisation, you represent and warrant that you have the authority to bind that organisation to these Terms.
3. Description of Service
Spectre AI Pro provides an AI-powered platform offering the following services:
- AI agent chat services for productivity, research, and business automation.
- Voice interaction features including speech-to-text and text-to-speech.
- A design studio for creating, editing, and exporting digital content.
- Project management and collaboration tools.
- Memory and context management for personalised AI interactions.
We reserve the right to modify, suspend, or discontinue any feature of the Service at any time, with reasonable notice where practicable.
4. Accounts and Authentication
You must provide accurate and complete information when creating an account. You are responsible for maintaining the security of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use of your account.
We offer authentication via email/password (bcrypt-hashed), Google OAuth, and Apple Sign In. You may close your account at any time by contacting admin@spectre.pro. Upon closure, your personal data will be deleted in accordance with our Privacy Policy.
5. Acceptable Use
You agree not to:
- Use the Service for any unlawful purpose or in violation of any applicable EU or national law.
- Generate, store, or distribute content that is illegal, harmful, threatening, abusive, harassing, defamatory, or otherwise objectionable.
- Attempt to gain unauthorised access to any part of the Service, other accounts, or computer systems or networks connected to the Service.
- Use the Service to develop, train, or improve competing AI models without our express written consent.
- Reverse engineer, decompile, or disassemble any part of the Service, except as permitted by applicable law (e.g., Article 15 of Directive 2009/24/EC for interoperability).
- Introduce viruses, malware, or any other malicious code into the Service.
- Use automated scripts, bots, or scrapers to access the Service in a manner that exceeds normal usage or degrades system performance.
- Process personal data of other individuals through the Service without a valid legal basis under GDPR.
6. AI-Generated Content
The Service uses AI models to generate text, code, and other content. You acknowledge and agree that:
- AI-generated content may contain errors, inaccuracies, or biased outputs. You are responsible for verifying and validating all AI-generated content before relying on it.
- AI-generated content should not be used as a substitute for professional advice (medical, legal, financial, or otherwise).
- In accordance with the EU AI Act (Regulation (EU) 2024/1689), we provide transparency about the AI nature of generated content. You must not present AI-generated content as human-created where this would mislead recipients.
- You retain ownership of the prompts and inputs you provide. AI-generated outputs are licensed to you for your personal and commercial use, subject to these Terms.
7. Intellectual Property
The Service, including its design, software, algorithms, and branding, is owned by Spectre AI Pro and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works from the Service without our prior written consent.
Content you create using the Service (conversations, projects, exports) remains your property. By using the Service, you grant us a limited licence to process your content solely to provide and improve the Service, as described in our Privacy Policy.
8. Fees and Payment
Certain features of the Service may require a paid subscription. Fees, billing cycles, and payment terms will be clearly displayed before any purchase. All prices include applicable VAT where required by EU law. You may cancel a subscription at any time, with access continuing until the end of the current billing period. Refunds are governed by EU consumer protection law, including Directive 2011/83/EU on consumer rights.
9. Service Availability
We strive to maintain high availability but do not guarantee uninterrupted access. We are not liable for downtime caused by maintenance, infrastructure failures, force majeure, or events beyond our reasonable control. We will provide reasonable notice of scheduled maintenance where practicable.
10. Limitation of Liability
To the maximum extent permitted by applicable law, including Article 7 of Directive 93/13/EEC on unfair terms in consumer contracts:
- The Service is provided “as is” and “as available” without warranties of any kind, whether express or implied.
- We are not liable for indirect, incidental, special, consequential, or punitive damages, or for loss of profits, data, or business opportunity.
- Our aggregate liability for any claim arising from the Service shall not exceed the amount you paid us in the 12 months preceding the claim.
- Nothing in these Terms excludes or limits liability that cannot be excluded or limited under applicable EU or national law, including liability for death or personal injury caused by negligence, fraud, or wilful misconduct.
11. Indemnification
You agree to indemnify and hold harmless Spectre AI Pro from any claims, damages, losses, or expenses (including reasonable legal fees) arising from your use of the Service, your violation of these Terms, or your infringement of any third-party rights, including intellectual property and privacy rights under GDPR.
12. Termination
We may suspend or terminate your access to the Service immediately, without notice, if you breach these Terms, pose a security risk, or engage in conduct that we determine is harmful to the Service or other users. Upon termination, your right to use the Service ceases immediately. You may terminate your account at any time by contacting admin@spectre.pro. Provisions that by their nature should survive termination (including intellectual property, limitation of liability, and indemnification) shall remain in effect.
13. Governing Law and Jurisdiction
These Terms are governed by the laws of Belgium, without regard to conflict of law principles. For disputes with consumers, the courts of Belgium shall have jurisdiction, and you may also bring proceedings in the courts of the EU Member State where you reside. For disputes with businesses, the courts of Brussels, Belgium, shall have exclusive jurisdiction. Nothing in these Terms affects your right to use alternative dispute resolution, including the European Online Dispute Resolution platform (ec.europa.eu/consumers/odr).
14. Digital Services Act (DSA) Compliance
In accordance with Regulation (EU) 2022/2065 (Digital Services Act), we provide transparent information about our content moderation practices, notice and action mechanisms, and internal complaint-handling systems. To report illegal content on the Service, contact admin@spectre.pro. We will process reports diligently and without undue delay.
15. Changes to These Terms
We may update these Terms from time to time. We will notify you of material changes via email or in-app notification at least 30 days before they take effect. Continued use of the Service after the effective date constitutes acceptance of the revised Terms.
